Official Store Policies & Legal Agreement

NOTICE OF BINDING AGREEMENT: The following policies constitute a legally binding agreement between Floriana Fabian (the "Business") and any individual who accesses, browses, or engages in any transaction through Floriana Fabian's store, Seasonally Yours, or affiliated digital presence (the "Customer," "Purchaser," or "User"). Continued use of the store, placement of any order, or engagement in any transaction on or after the Effective Date of July 15, 2026, shall constitute the Customer's full and unconditional acceptance of all terms set forth herein. Customers who do not agree to these terms must immediately cease use of the store and refrain from placing any orders.

SECTION 5. RETURN AND REFUND POLICY
The following Return and Refund Policy governs all requests for returns, exchanges, and refunds in connection with purchases made through the Floriana Fabian store. This Policy is effective as of July 15, 2026, and applies to all orders placed on or after that date.
5.1 All Sales Presumptively Final. All sales made through the Floriana Fabian store are presumptively final. Returns and exchanges are accepted solely under the specific conditions expressly enumerated in this Section 4. No return, exchange, or refund shall be granted on any basis not explicitly provided for herein.
5.2 Return Request Window. Any request to return an eligible item must be submitted to Floriana Fabian in writing within seven (7) calendar days of the date of confirmed delivery of the order, as evidenced by carrier tracking records. Return requests submitted after the expiration of this seven-day window will be denied without exception and without further review, regardless of the reason advanced by the Customer.
5.3 Condition Requirements for Returned Items. All items submitted for return must satisfy each of the following conditions without exception:
(a)The item must be in its original, unused, unworn, unwashed, and unaltered condition;
(b)All original tags, labels, packaging, and documentation must be fully intact and attached; and
(c)The item must be free from any odors, stains, pet hair, or other evidence of use or alteration.
Floriana Fabian reserves the right, in its sole and absolute discretion, to reject any returned item that does not fully satisfy the foregoing conditions. Rejected returns will be shipped back to the Customer at the Customer's expense.
5.4 Non-Returnable and Non-Refundable Items. The following categories of items are strictly non-returnable and non-refundable under any circumstances, without exception:


5.5 Refund Issuance Timeline. Upon receipt and satisfactory inspection of an approved returned item, Floriana Fabian shall process and issue any approved refund to the original payment method used by the Customer within ten (10) to fourteen (14) business days. The actual date on which the refunded amount is reflected in the Customer's account is subject to the policies and processing times of the Customer's financial institution, which are beyond Floriana Fabian's control. Floriana Fabian does not guarantee any specific refund timeline beyond the foregoing window.
5.6 Non-Refundable Shipping Costs. Original shipping costs are non-refundable under all circumstances. Return shipping costs are the sole financial responsibility of the Customer, except in cases where the return is necessitated by a verified manufacturing defect in the product or a demonstrable error made by Floriana Fabian in fulfilling the order. In such excepted cases, Floriana Fabian will provide a prepaid return shipping label.
5.7 Fraudulent Return Attempts. Any attempt to perpetrate return fraud — including but not limited to returning items materially different from those originally purchased, returning counterfeit, damaged, or used items in place of the original, or making false representations in connection with any return claim — shall constitute a serious breach of these Terms and Conditions and shall result in the following consequences:
(a)Immediate and permanent termination of the Customer's account and all associated purchasing privileges with Floriana Fabian;
(b)Reporting of the fraudulent activity to applicable law enforcement authorities; and
(c)Civil action against the Customer to recover all losses, costs, and damages resulting from the fraudulent conduct, including reasonable legal fees.
5.8 Unauthorized Chargebacks. The initiation of a chargeback, payment dispute, or payment reversal through the Customer's financial institution or payment processor without first seeking and exhausting Floriana Fabian's internal dispute resolution process as set forth in these Terms and Conditions shall constitute a material breach of this agreement and may result in any or all of the following:
(a)Permanent suspension and ban of the Customer from all Floriana Fabian purchasing channels;
(b)Initiation of collection proceedings against the Customer to recover the full disputed amount, together with any associated chargeback fees, administrative costs, and legal expenses incurred by Floriana Fabian; and
(c)Reporting of the Customer's information to applicable chargeback fraud monitoring databases and networks utilized by payment processors and financial institutions.
