Official Store Policies & Legal Agreement

NOTICE OF BINDING AGREEMENT: The following policies constitute a legally binding agreement between Floriana Fabian (the "Business") and any individual who accesses, browses, or engages in any transaction through Floriana Fabian's store, Seasonally Yours, or affiliated digital presence (the "Customer," "Purchaser," or "User"). Continued use of the store, placement of any order, or engagement in any transaction on or after the Effective Date of July 15, 2026, shall constitute the Customer's full and unconditional acceptance of all terms set forth herein. Customers who do not agree to these terms must immediately cease use of the store and refrain from placing any orders.

SECTION 4. SHIPPING POLICY
The following Shipping Policy governs all aspects of order processing, dispatch, delivery, and associated responsibilities as between Floriana Fabian and the Customer. This Policy is effective as of July 15, 2026.
4.1 Order Processing Time. All orders placed through the Floriana Fabian store are subject to a standard processing period of one (1) to five (5) business days prior to dispatch. Processing time commences upon Floriana Fabian's receipt and verification of full payment. Orders placed on weekends, public holidays, or during periods of announced store closures will begin processing on the next applicable business day. Floriana Fabian reserves the right to extend processing times without notice during periods of high order volume, limited inventory availability, or other operational exigencies.
4.2 Shipping Destinations. Floriana Fabian currently ships to addresses within the contiguous United States and to select international destinations. The availability of shipping to any particular international destination is subject to change without notice and at the sole discretion of Floriana Fabian. Floriana Fabian reserves the right to decline any order that cannot be lawfully or practically fulfilled due to shipping restrictions, carrier limitations, or applicable export regulations.
4.3 Delivery Estimates; No Guarantee. Any delivery timeframes communicated to the Customer at the time of purchase, whether on the store, in order confirmation communications, or otherwise, are estimates only and are not guaranteed. Floriana Fabian shall not be held liable for any delays in delivery arising from carrier operational issues, adverse weather conditions, acts of God, force majeure events, customs processing delays, or any other circumstances beyond the direct operational control of Floriana Fabian.
4.4 Transfer of Risk of Loss. Risk of loss, damage, or destruction of any order shall transfer from Floriana Fabian to the Customer upon Floriana Fabian's tender of the order to the designated shipping carrier. From and after the moment of such tender, Floriana Fabian bears no further liability for the physical condition, location, or delivery status of the order.
4.5 Customer Responsibility for Shipping Information. The Customer is solely and exclusively responsible for providing complete, accurate, and current shipping information at the time of checkout. Floriana Fabian shall not be liable for any undelivered, lost, delayed, or misrouted packages that result, in whole or in part, from the Customer's provision of inaccurate, incomplete, or outdated shipping information. In such cases, no refund shall be issued for any unrecoverable shipment.
4.6 Lost or Damaged Packages. Claims for lost or damaged packages must be reported to Floriana Fabian in writing within seven (7) calendar days of the confirmed or estimated delivery date, whichever is earlier. Claims submitted after the expiration of this seven-day reporting window may be denied in their entirety, at the sole discretion of Floriana Fabian. Floriana Fabian reserves the right to require documentation, including photographic evidence of damage or carrier correspondence, in connection with any claim.
4.7 International Shipments; Customs and Import Responsibilities. Customers receiving orders at international addresses are solely and exclusively responsible for:
(a)All applicable customs duties, import taxes, value-added taxes, tariffs, and any other fees or levies imposed by the destination country's customs or governmental authorities;
(b)Compliance with all import regulations, restrictions, and requirements applicable in the destination jurisdiction; and
(c)Any consequences arising from the confiscation, seizure, destruction, or detention of any shipment by customs authorities or any governmental body. Floriana Fabian shall bear no liability whatsoever for any such outcome, and no refund shall be issued with respect to any shipment so affected.
4.8 Returned-to-Sender Packages; Reshipping Fees. In the event that a package is returned to Floriana Fabian by the carrier due to an incorrect or insufficient address, a failed delivery attempt attributable to Customer unavailability, or any other circumstance attributable to Customer error, the Customer shall be required to pay all applicable reshipping fees prior to any re-dispatch of the order. Floriana Fabian shall not issue a refund for the original shipping costs in such circumstances. If the Customer elects not to have the order reshipped, a partial refund of the product value only (exclusive of original and return shipping costs) may be considered at Floriana Fabian's sole discretion.
